Tenstorrent Console Terms of Use

Welcome

The TT Console Platform enables developers and partners to evaluate Tenstorrent's high-performance hardware and software ecosystem in a cloud-based demonstration environment. Our goal is to provide a unified platform for showcasing hardware capabilities, performance benchmarking, and early-stage software evaluation.

Built for the AI, the TT Console provides the tools needed to test and optimize next-generation workloads on Tenstorrent architecture.

Important Notice

This Service is provided for non-commercial, demonstration, and evaluation purposes only. It is a prerelease demo version provided "as-is" and has not completed Tenstorrent's full quality assurance testing.

By completing the registration process, accessing, or using any part of the Service, you agree that:

  1. You have read, understand, and agree to be bound by this Agreement.
  2. You have the authority to bind yourself personally or the legal entity associated with your registration account.
  3. This Agreement is revocable by Tenstorrent at any time.

If you do not agree to these terms, you may not access or use the Services.

Please read our Privacy Notice, which describes how we collect and use personal information.

1. Provision of the Platform

Subject to your continued compliance, Tenstorrent hereby grants you during the Evaluation Term a revocable, non-exclusive, non-transferable, non-sublicensable and royalty-free right to access and use the Service, solely for internal purposes to test and evaluate Tenstorrent hardware and software performance.

2. Accounts & Authentication

Registering Your Account: In order to access certain features of the Service, you must become a Registered User. A "Registered User" is a user who has registered an account on the Service ("Account") via a valid account on a third-party authentication service such as GitHub or Google (each, a "Third-Party Account").

Access Through an Authentication Service: By linking your Account with Third-Party Accounts, you represent that you are entitled to grant Tenstorrent access to your Third-Party Account without breach of any third-party terms and conditions. Tenstorrent may access and store any information or materials accessible through the Service that you have provided to your Third-Party Account ("Authentication Data"). YOUR RELATIONSHIP WITH THIRD-PARTY SERVICE PROVIDERS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH THEM. TENSTORRENT DISCLAIMS ANY LIABILITY FOR PERSONALLY IDENTIFIABLE INFORMATION PROVIDED BY SUCH PROVIDERS IN VIOLATION OF YOUR PRIVACY SETTINGS.

Registration Data: You agree to provide accurate and complete Registration Data. You represent that you are at least eighteen (18) years old and not a person barred from using the Services under the laws of the United States or other applicable jurisdictions. You may not share your Account or password with anyone.

Responsibility: You are responsible for all activities occurring under your Account.

Corporate Domains: If you create an Account using an email address owned by an organization (e.g., your employer), that Account may be added to the organization's business account with us. In such a case, the organization's administrator will be able to control your Account, including accessing Content and restricting or removing your access.

3. Restrictions

Unless otherwise authorized by Tenstorrent in writing, You shall not:

  • Sublicense, rent, lease, or provide any third party with access to the Service;
  • Decompile, reverse engineer, or attempt to derive the source code of any part of the Service infrastructure or proprietary hardware-level APIs;
  • Circumvent any security features, geo-fencing, or license management mechanisms;
  • Represent that Output was human-generated when it was not;
  • Use the Service or its Output to develop models or products that compete with Tenstorrent hardware, patents, or services.

4. Ownership & Feedback

Tenstorrent and its licensors retain all right, title, and interest in and to the Service, including the underlying hardware architecture and any derivative works. User hereby irrevocably assigns to Tenstorrent all right, title, and interest in any Feedback (comments, suggestions, or ideas) provided. Tenstorrent may exploit Feedback without restriction or compensation.

5. Data & Public Evaluation Disclosure

"User Data" means (i) any data provided or transmitted by User into the Service ("Input"), and (ii) the text, image, video, or audio outputs resulting from User's use of the Service ("Output"). Subject to the license granted to Tenstorrent in this Section 5, as between Tenstorrent and You, you own all right, title, and interest in and to the Output, provided that your ownership only applies to the extent the Output does not infringe the intellectual property rights of any third party. Tenstorrent makes no representation that any Output is free of third-party claims, and you are solely responsible for evaluating your results for potential infringement before any use or distribution. You grant Tenstorrent a limited, worldwide license to access, use, and copy User Data solely to provide, maintain, and update the Service and for the training, optimization, and development of Tenstorrent's hardware and machine learning models. Due to the nature of machine learning, Output may not be unique across users, and other users may receive similar output from the Service. Our assignment of ownership in Output does not extend to other users' output.

You acknowledge that the Service utilizes machine learning models trained on publicly available data, which may include copyrighted material. As a result, Output may inadvertently resemble or reproduce elements of existing copyrighted works, trademarks, or other protected material. Tenstorrent does not guarantee that Output will be free from third-party intellectual property claims. You are solely responsible for reviewing all Output and ensuring that your use of it complies with applicable intellectual property laws before any use, publication, or distribution.

You acknowledge that the Service is a public evaluation environment.

The Services are not designed to process or store sensitive personal data or proprietary trade secrets. You must not submit or input any sensitive personal data (including, without limitation, financial information, government identifiers, health data, or other highly sensitive information) or proprietary trade secrets into the Services. You are solely responsible for ensuring that any data you provide complies with applicable laws and does not include prohibited categories of information.

Output quality is dependent on the quality of the Input provided by You. Due to the experimental nature of the Service, Outputs may be inaccurate or incomplete. Use of any Output is at Your sole risk. You should not rely on Output from our Services as a sole source of truth or factual information, or as a substitute for professional advice. You must not use any Output for any purpose that could have a legal or material impact on a person, such as making credit, educational, employment, housing, insurance, legal, or medical decisions.

Tenstorrent reserves the right, but is not obligated, to monitor, review, and log any Input and Output at any time to ensure compliance with this Agreement and to improve hardware performance. You should have no expectation of privacy regarding the content of your prompts or generated media. Tenstorrent may use data concerning Your use of the Services in an aggregated and anonymous manner ("Usage Information"), including but not limited to compiling statistical and performance information related to the operation of the Services, determining usage trends, performing analytics, improving the Services, promoting and marketing the effectiveness of the Services, or for any other ordinary business purpose, provided that such uses shall relate to Tenstorrent's obligations to provide the Services to Users. You agree that Tenstorrent may make Usage Information publicly available, provided that such information does not identify You either directly or indirectly. Tenstorrent retains all intellectual property rights in Usage Information. Tenstorrent shall have no obligation or liability in connection with any use of Your Data which is anonymized or otherwise de-personalized, unless, and to the extent, restricted by applicable law.

Unless expressly agreed to by Tenstorrent in writing elsewhere, Tenstorrent has no obligation to store User Data and is not liable for the deletion of or failure to store any User Data or generated media. Tenstorrent has no responsibility or liability for the deletion or accuracy of any User Data or the failure to store, transmit or receive transmission of User Data.

6. User Conduct & Open Source Model Policies

As a condition of use, You agree not to use the Services for any purpose that is prohibited by this Agreement or applicable law. You agree to comply with all applicable laws and the following "Zero Tolerance" rules:

  • Third-Party Model Policies: You must comply with the Acceptable Use Policies of any open-source models (e.g., Llama) accessed via the Service.
  • Multimodal Safety: You shall not generate unauthorized digital replicas (likeness/voice), deceptive deepfakes intended to influence elections, or any content sexualizing minors.
  • System Integrity: You shall not interfere with the system via automated scraping, crawling, or introducing harmful code.
  • Prohibited Content: You shall not generate, post, or share content that:
    • Is unlawful, libelous, defamatory, obscene, pornographic, suggestive, harassing, or fraudulent;
    • Infringes or misappropriates any patent, trademark, trade dress, copyright, publicity right, or other intellectual property right of any party, including without limitation the generation of content depicting copyrighted characters, trademarked logos, or other protected works without authorization from the rights holder;
    • Contains private or personal information of a third party without consent;
    • Depicts expressions of hate, abuse, or offensive conduct.
  • Monitoring and Removal: Tenstorrent reserves the right, in its sole discretion, to monitor, review, and remove any User Data at any time, for any reason or no reason, without notice.

7. Investigations

Tenstorrent may, but is not obligated to, monitor or review Services and User Data at any time. Without limiting the foregoing, Tenstorrent shall have the right, in its sole discretion, to remove any User Data for any reason (or no reason), including if such User Data violates the Agreement or any applicable law.

8. Fees

The Service is currently provided free of charge for non-commercial demo purposes. Tenstorrent reserves the right to modify this Agreement to charge fees at its sole discretion in the future.

9. Term & Termination

This Agreement commences on the Effective Date and shall continue in effect until terminated in accordance with this Section 9 ("Evaluation Term"). Either party may terminate this Agreement for convenience upon prior written notice to the other party. Either party can extend upon mutual agreement by both parties. Upon expiration or termination of this Agreement for any reason, (a) the license granted to User in Section 1 will automatically terminate; (b) You must immediately cease all use of the Service. Sections 2–7 and 10–16 shall survive any expiration or termination of this Agreement. For purposes of this Agreement, "Effective Date" means the earlier of (i) the date Tenstorrent provides You with access credentials to the Service, or (ii) the date You first access the Service.

10. DMCA Notice

Tenstorrent respects intellectual property rights. If you believe your work has been infringed, please send a written notice to our Copyright Agent:

Your notice must include: (i) a physical or electronic signature; (ii) description of the copyrighted work; (iii) the location of the infringing material on our site; (iv) your contact info; (v) a statement of good-faith belief; and (vi) a statement of accuracy under penalty of perjury.

Tenstorrent will terminate the accounts of users who are found to repeatedly infringe the intellectual property rights of others.

11. Warranty Disclaimers

The version of the Service that is provided to User pursuant to this Agreement is a prerelease, untested version and is provided "as is" and "as available". Tenstorrent provides the Service "as-is" and without warranty of any kind. Tenstorrent hereby expressly disclaims and waives all warranties, whether express or implied, written or oral, with respect to the Service, including, without limitation, any warranties regarding accuracy, operability, use, non-infringement, title, merchantability, and fitness for a particular purpose. In addition, Tenstorrent does not warrant that the Service will be uninterrupted or error-free, or that any defects will be corrected and Tenstorrent grants no warranty regarding its use or the results therefrom. You acknowledge that use of the Service is at your sole risk.

12. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Tenstorrent and its affiliates from and against any and all claims, costs, damages, or expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Services; (b) your User Data; (c) your violation of these Terms; or (d) any claim that your Output infringes or misappropriates the intellectual property rights of a third party.

13. Limitations on Liability

To the fullest extent permitted by applicable law: (a) Tenstorrent will not be liable to User under any theory of liability for any indirect, incidental, consequential, special, exemplary damages or any loss of profits, data, revenue, or for damage to reputation or good will arising out of this Agreement or your use of the Services; and (b) in no event will Tenstorrent's total liability arising under this Agreement exceed one hundred dollars ($100.00).

14. Modification

Tenstorrent reserves the right, at any time, to modify, suspend, or discontinue the Service or Your access to the Service, for any reason or no reason at all, with or without notice. We may update the Terms of Use from time to time to reflect changes in the law, security requirements, or our hardware capabilities. For material changes that adversely impact your rights, we will provide at least thirty (30) days' advance notice via email or a prominent notification within the Service before the changes take effect. All other changes (such as minor bug fixes to terms or non-material updates) are effective immediately upon posting to our platform. If you do not agree to the updated Terms of Use, you must stop using the Service before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your consent to such changes.

15. Export Control

You acknowledge that the Service involves remote access to high-performance AI hardware. You may not use, export, import, or transfer the Services except as authorized by U.S. law, the laws of the jurisdiction in which User obtained Services, and any other applicable laws. In particular, but without limitation, the Services may not be exported or re-exported (a) into any United States embargoed countries, or (b) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce's Denied Person's List or Entity List. By using the Services, You represent and warrant that (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country and (ii) You are not listed on any U.S. Government list of prohibited or restricted parties. You also will not use Services for any purpose prohibited by U.S. law, including the development, design, manufacture or production of missiles, nuclear, chemical or biological weapons. You acknowledge and agree that products, services or technology provided by Tenstorrent are subject to the export control laws and regulations of the United States. You shall comply with these laws and regulations and shall not, without prior U.S. government authorization, export, re-export, or transfer Tenstorrent products, services or technology, either directly or indirectly, to any country in violation of such laws and regulations.

16. Miscellaneous

You agree that any violation or threatened violation of this Agreement may cause irreparable injury to Tenstorrent, entitling Tenstorrent to seek injunctive relief in addition to all other legal remedies. This Agreement constitutes the entire agreement between the parties with respect to Your use of the Service, and supersedes all prior or contemporaneous understandings or agreements, whether oral or written, express or implied. This Agreement will be governed by the laws of the State of California, without regard to its conflicts of laws principles. Any controversy or claim arising out of or relating to this contract, or the breach thereof, including but not limited to any controversy or claim arising out of or relating to the design, development, license, sale, or use of artificial intelligence (AI), machine learning, large language model, or generative AI systems, tools, or products, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Parties agree to attempt informal resolution for at least 60 days before initiating arbitration. Claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. If 25 or more similar claims are filed by the same counsel, they will be resolved in batches of up to 50 to ensure efficient resolution. Except for small claims court, any dispute not subject to arbitration will be brought exclusively in the courts of San Francisco, California. Any waiver of a right arising under this Agreement must be made in writing and signed by the party making the waiver. This Agreement may only be amended in a writing signed by the parties. You may not assign this Agreement without Tenstorrent's prior express written consent. Any attempted assignment in violation of the prior sentence constitutes a breach of this Agreement. If any provision of this Agreement is held by a court of competent jurisdiction to be unenforceable, then the remaining provisions of this Agreement will remain in effect. Any notice to You may be provided by email, and you are responsible for providing Tenstorrent with your most current e-mail address. In the event that the last e-mail address you provided to Tenstorrent is not valid, or for any reason is not capable of delivering to you any notices required/permitted by this Agreement, Tenstorrent's dispatch of the e-mail containing such notice will nonetheless constitute effective notice. You may give notice to Tenstorrent at the following address: Tenstorrent USA, Inc., Attn: Legal, 2550 Great America Way, #150, Santa Clara, CA 95054. Such notice shall be deemed given when received by Tenstorrent by letter delivered by nationally recognized overnight delivery service or first-class postage prepaid mail at the above address.
